DMCA Claims
As we all know the internet is full of royalty free images. Magazines and other providers often release photos they do not intend to use and photographers release images they find they cannot sell (This is why some images on blogs are often time a bit blurry or poor quality). The chances of running into a DMCA claim over a celebrity that has not been issued by the celebrity is very rare. In fact a person would assume that laws would not allow a person to sell an image of another person without that person having the celebrities permission. Yet not only is it legal and possible it does happen. It would seem this blog has gotten popular because I have been hit with a DMCA take down notice (another blogger sends you an email threatening legal action if you do not remove an image from your website). I take these very seriously (agree with or not) and will listen to the claim (or read it). On the other hand more than 57% of DMCA claims are invalid claims made by competing companies or blogs. In the year I have been blogging I have had several unprofessional things done to take my blog down by bloggers posting similar content (go figure I’m not selling a product). So on one hand I do take the claims seriously on the other I do not know you so I do not trust you. So if you take offense to me checking the validity of your claim I normally assume it is not valid. If you do have a claim to make send me the link to the post(the post I have made) and the link to original content provider (the people you bought the image from) I will check my sources (were I got the image from) and your information. If the claim is valid I will remove the post, or just the images.
In all these situations I am courteous an attentive so I expect the same. I am not a thief and tend to trust that my sources are all posting royalty free images. There is no reliable way to know that an image is not royalty free unless the owner “TAGS” his or her image. If you would like to know the source of most of my images they are linked on my website. I do not make a secrete were I get my images. My contact information and ISP are listed above. You will need both of these.
